Introduction
A ‘Bespoke Product’ refers to any original fully or partially bespoke pieces, customised pieces, and pieces where the product is manufactured especially for the client. Any information not included on this page but written on other sections of the website are still valid and would still count as terms of sale.
Acceptance of order
The contract will be between the client and Hafeez to provide a finished piece of jewellery as per the agreed design illustration, in accordance with these terms and conditions, and the terms of the sales invoice issued.
Acceptance of the order will not take place until a non-refundable deposit of 50% (or otherwise stated) is received in full, at which point a contract will come into existence between the client and Hafeez, and it will be deemed that the client has accepted these terms and conditions.
Consumer's rights to end the contract
The consumer's rights to cancel a contract under the Consumer Contracts Regulations 2013 do not apply to Bespoke Products.
If for any reason you wish to cancel an order for a Bespoke Product you should contact us immediately but please note that the 50% deposit (or amount otherwise agreed) is non-refundable.
In some circumstances we may be able to cancel your order and charge a reduced price, but this will not be appropriate in all circumstances and you may still be charged the full price.
We may charge you reasonable compensation for the net costs we will incur as a result of the consumer breaking the contract.
Company's rights to end the contract
If we are unable to accept your order, for any reason, we will inform you immediately.
If we need to terminate the contract once it comes into existence, and are unable to contact you despite our reasonable efforts for a period of 15 working days, the 50% deposit (or amount otherwise agreed) will be non-refundable and you may still be charged the full product price.
Design and manufacture
During the consultation, drawings and sketches of your requested design and specifications will be made. The manufacturing process won't begin until you have confirmed in writing that you are happy with the design and its specifications, which will have been confirmed to you in writing, as well as the payment of a 50% deposit.
Because each of the Bespoke pieces are one of a kind and handmade, there may be some very slight variations between the approved design and the finished product. Such variations do not constitute faults in the final product.
Design amendments
We are happy to discuss design alterations at any point in the process and will strive to accommodate your requests. However, once we've finalized the design and manufacturing has begun, making alterations may become impractical.
Should alterations be possible, any associated costs will be communicated to you in writing. Additional charges may apply for significant alterations or if the changes involve extra work or different materials. These charges might necessitate full payment before continuing with the design or could be added to the remaining balance.
Completion dates
If you've placed an order for a Bespoke Product, we'll provide you with an estimated completion date, typically around six-twelve weeks from the date your order is accepted.
However, it's essential to note that while we make every effort to meet these completion dates, our commitment to crafting exceptional jewellery means that quality is never compromised or rushed. Therefore, please understand that the completion date provided is an estimation and may vary.
Collection and delivery
Upon notification that your order is ready for insured delivery, it is expected that payment for the finished product occur within a maximum of 5 days.
Jewellery in-person delivery is available by appointment during regular working hours, excluding weekends and public holidays, unless agreed otherwise.
Should delivery arrangements not be made, and attempts to reach you prove unsuccessful, we reserve the right to terminate the contract, and retain the 50% deposit.
Price and payment
The product price, inclusive of VAT, is outlined on the sales invoice. Upon placing your order, you are consenting to the specified payment terms detailed in the sales invoice.
Any quotation or invoice remains valid for fifteen business days.
To initiate your order and commence any CAD design or manufacturing, a non-refundable deposit of 50% (unless otherwise stated) of the total invoice is required.
Unless otherwise agreed, full payment of the product(s) is necessary before collection or delivery. This also encompasses payment for any additional charges resulting from approved changes after final design approval.
For Bespoke Products, balance payments must be settled within 5 days of invoice issuance.
Upon receiving full payment, we will ship the jewel via insured courier.
Returns and refunds
Bespoke Products are uniquely crafted or tailored specifically for you. As a result, refunds or exchanges will not be provided for any bespoke or customized jewellery, unless the final product is determined to be inaccurately described, faulty, or defective.
Gemstones, e-gift cards and sketches are non-refundable and non-exchangeable.
Marketing and intellectual property
The payment for a Bespoke Product covers only the finished item. All intellectual property rights related to the design, drawings, images, or the final product remain under Hafeez ownership, including sketches.
Hafeez retains the full right to utilize photos and/or videos showcasing the product(s) on the website, social media channels, and any marketing materials to promote the business.
Ensuring ownership rights in any materials provided to us or in requested designs is your responsibility.
This section remains in effect even after the terms and conditions are terminated.
Sizing
Clients are entitled to a first complimentary resize of up to 3 sizes smaller or larger than the original within 30 days after collecting their ring.
Following this period, resizing services will be subject to evaluation and potential charges.
If resizing falls outside the designated range or if the ring's design doesn't allow for resizing, complete remaking of the ring might be necessary, and the associated costs will be client's responsibility.
Client's stones and jewellery
Considerable care and responsibility are exercised for any stones or jewellery entrusted to us. However, it's crucial that these items are adequately insured under your personal insurance policy. Acceptance of any risk associated with these items during their tenure in our care is your responsibility, and ultimately, Hafeez holds no liability for them. You will be required to sign a waiver agreement form before proceeding.
Regarding stone-set pieces, as the history of the stone or jewellery is often unknown, Hafeez cannot assure its structural integrity. Consequently, Hafeez cannot be held accountable for any damage or breakage that may occur while it's under its possession. Please note, if any damage or imperfections posing a risk are discovered during the un-setting of the stone(s), you will be promptly notified.
If you decide to go ahead with the dismantling of the jewellery but not with the bespoke design, the disassembled components will be sent back to you via insured delivery. We reserve the right to charge you for the delivery, the service charge, and any additional costs incurred.

Guarantee
Bespoke Products are accompanied by a lifetime guarantee from the date of purchase against any manufacturing defect.
Please note that the guarantee does not cover any damage to, or loss of diamonds or gemstones.
The guarantee does not cover damage caused by wear and tear, accidental damage, or loss or theft, and any work, repair or modification of your jewellery not conducted by Hafeez will void the guarantee.

Force majeure
Hafeez shall not be held liable for any failure, either in part or in entirety, to fulfil its obligations under the contract due to circumstances beyond the reasonable control of the Company or its suppliers.
Further information
By proceeding with the commission, you affirm your acceptance of these terms and conditions and agree to adhere to them. If you disagree with these terms, refrain from proceeding with the commission. We recommend keeping a copy for future reference.
Each paragraph in these terms and conditions functions independently. Should any court or relevant authority rule any of them unlawful, the remaining paragraphs will continue to remain valid and enforceable.
